The Four Degrees of Criminal Sexual Conduct

Michigan grades CSC into four tiers based on the nature of the conduct (penetration vs. contact) and statutory aggravating factors:

  • First-Degree CSC (MCL 750.520b): Involves sexual penetration combined with aggravating circumstances (such as victim under 13, personal injury, weapon, or penetration during another felony). Felony punishable by life or any term of years, with mandatory minimums of 25 years in specific child cases.
  • Second-Degree CSC (MCL 750.520c): Involves sexual contact (touching of intimate parts) with aggravating circumstances. Felony punishable by up to 15 years.
  • Third-Degree CSC (MCL 750.520d): Involves sexual penetration accomplished by force or coercion, or penetration with a person at least 13 and under 16 years of age. Felony punishable by up to 15 years.
  • Fourth-Degree CSC (MCL 750.520e): Involves sexual contact under specific statutory circumstances. High-court misdemeanor punishable by up to 2 years in prison and/or a $500 fine.
