Do I have to answer police questions?
No. Under the Fifth Amendment you have the right to remain silent. In Michigan you generally must identify yourself, but you are not required to answer questions about where you've been, what you were doing, or whether you were drinking. Politely say you wish to remain silent and want a lawyer -- then stop talking.
Can police search my car or home without a warrant?
Usually not. The Fourth Amendment protects you from unreasonable searches. Police generally need a warrant, your consent, or a recognized exception. You are not required to consent -- you can clearly state that you do not consent to a search, and that objection can matter a great deal later.
What should I do if I'm arrested?
Stay calm and do not resist, even if you believe the arrest is unlawful -- argue it in court, not on the street. State that you are exercising your right to remain silent, ask for a lawyer, and do not discuss your case with anyone until you've spoken with an attorney.
How quickly should I hire a defense attorney?
As soon as possible. The earlier we're involved, the more we can do -- preserving evidence, protecting your rights during questioning, and sometimes influencing whether charges are filed at all. If you're under investigation, involving counsel before charges are filed gives an attorney the most room to work.
Will my case go to trial?
Not necessarily. Many criminal cases are resolved through motions, negotiation, or diversion programs before trial. But we prepare every case as if it will be tried -- that readiness is often what produces a better resolution short of trial.
Am I eligible for expungement in Michigan?
Possibly. Michigan's set-aside law is MCL 780.621 et seq. The 2020 Clean Slate package (2020 PA 187–193) broadened eligibility, and automatic set-aside of some convictions began in 2023 -- but assaultive crimes and serious misdemeanors, including domestic assault, are excluded from automatic set-aside under MCL 780.621g(10) and always require an application. First-offense OWI became eligible separately under 2021 PA 78, effective February 19, 2022, and is never automatic. A set-aside is discretionary, so eligibility depends on the offense and your record.
